Falwell on Pledge Decision

Jerry Falwell argues that the daughter of the man who brought the "under God" lawsuit believes in God and goes with her mother to Sunday school. Now, Falwell thinks this ideological custody battle parents undermines the case, but it actually reinforces it.

This case was not a free exercise case, where it matters much more what the child may want, but an establishment case, where the whole issue is the potential power of schools to shape children's religious beliefs. The very fact that the pledge wording matters to the parents (and anyone else) is actually pretty good proof that it's not an innocuous phrase but a significant statement of faith that matters to the girl's mother who is "a Sunday school teacher."
