<< Fox Lawsuits: More Support for Free Speech | Main | Dividing Up the Education Goodies >> November 09, 2003Turnabout- Fox Sued for Trademark ViolationFox has been sued by the music group Arrested Development for using their name for their new sitcom of the same name. Fox in its defense: Fox said in a statement the show's title is a commonplace expression as well as "an established psychological condition." Arrested development is defined as "an abnormal state in which development has stopped prematurely."All true and they should win their suit -- but goose for the gander is still very sweet. There should be a basic rule-- if you want a trademark, make up a word. Use regular nouns or phrases and the courts should just dismiss the case on day one.
