The Democrats have a simple response to disprove it. Filibuster a bunch of white nominees as well. Such as Charles Pickering who Bush has renominated. At this article notes: But Louise Bogard, legal director for the Alliance for Justice — one of the groups that opposed the nominations of Charles Pickering and Estrada — said the fight over Estrada has strengthened the Democrats' resolve to block the promotions of Charles Pickering and other conservative judges. Charles Pickering has been nominated for a seat on an appeals court that hears cases from Mississippi, Louisiana and Texas.And think about it. The Republicans have now put a bunch of moderate Democrats on record voting against Estrada. So the Republicans have pretty much forced them to filibuster others.
