<< Fed Upbeat Report Unconvincing | Main | Why School Testing is Evil >> July 30, 2003Will Bustamante Take Over?Well this from Sac Bee columnist Daniel Weintraub could upset the applecart: Former state legislator Barry Keene, the author of the infamous words "if appropriate" in Article II of the constitution, has researched his records and refreshed his memory of the 1974 amendment he sponsored that added those words while striking hundreds of others from the recall provision...He says they were intended to ensure that the lieutenant governor would become governor in the case of a recall. Not that the memory of the author of legislation is definitive, but it adds to the argument that if Davis is voted out, there is a perfectly good lieutenant governor available to succeed him. But, my impression based on the little I have read is that there are going to be 2 items on the ballot with the first being approval/disapproval of the recall and the second being who is to replace Davis as Gov. So given that the second item would elect a new Governor, how can the Lt. Gov. become Gov.? Doesn't the ballot obviate this possibility? Posted by: Barry Freed at July 30, 2003 07:52 PM Barry Freed: I think what Article II means is that including that second question on the ballot could be legally challenged and disallowed.
